Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the familyTravely website and related services (the "Service"), which are operated by an individual ("we," "us," or "our"). familyTravely is the brand name for the Service; it is not a registered company or other separate legal entity. By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Please read these Terms together with our Privacy Policy.
Eligibility
You must be at least the age of majority in your jurisdiction to use the Service, or use the Service only with the involvement and consent of a parent or legal guardian. The Service is intended for adults planning family travel, not for unsupervised use by children.
Description of familyTravely
familyTravely provides a web-based trip planning experience. You enter trip preferences and constraints, and our rule-based planning engine generates a suggested day-by-day itinerary, including activities, meals, travel segments, maps, and estimated costs where available. Features may include downloading a PDF, sharing an itinerary by email, and opening third-party links for directions, tickets, lodging, or transportation.
After you generate an itinerary, you may view it at a trip address in the same browser session while the Service keeps a copy in your browser's session storage. That access is session-bound and is not guaranteed on another device or after you clear or lose session data. A durable link that others can open is created only when you explicitly share an itinerary by email, as described in our Privacy Policy.
You do not need to create an account to use the core planning features described in our current product.
Free planning functionality
The Service is currently offered without charge for itinerary planning in the form we provide today. We may introduce optional paid features in the future. If we do, we will present applicable terms and pricing before you are charged.
User-provided information
You are responsible for the accuracy of information you enter (for example, dates, children's ages, dietary preferences, and accommodation details). You agree not to submit information you do not have the right to use or that violates another person's rights.
Please avoid entering unnecessary personal data about children beyond what the planner needs (such as ages).
Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, or abusive purposes
- Attempt to disrupt, overload, scrape, or reverse engineer the Service
- Circumvent rate limits or security measures
- Misuse share links or email features to harass or spam others
- Infringe intellectual property or privacy rights
We may suspend or block access if we reasonably believe you have violated these Terms.
Intellectual property
The Service, including its software, design, branding, and planning logic, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial trip planning in accordance with these Terms.
familyTravely-generated content
Itineraries and related text, schedules, maps, and cost estimates are generated for your convenience. You may use your generated itinerary for personal trip planning. You may not resell, publicly republish, or commercially exploit our planning output or the Service itself without our prior written permission, except as allowed by applicable law.
Third-party content and services
The Service relies on third-party data and services (including Google Maps and Places, venue information, and booking partners). Third-party names, logos, and content belong to their respective owners. Your use of third-party services is subject to their terms and policies.
Some itinerary links may be commercial or affiliate links. Where shown, disclosure text appears with Travel Extras and related booking shortcuts on your itinerary—not as a separate guarantee of price, availability, or suitability.
Maps and location information
Maps, routes, travel times, and location suggestions are estimates and may be incomplete or outdated. Road conditions, closures, transit schedules, and GPS accuracy can change. Always verify routes and timing using your own judgment and official sources before traveling.
Restaurants, attractions, transportation, and travel information
Opening hours, prices, availability, age requirements, accessibility, safety rules, and reservation policies for venues and transport providers change frequently. An attraction or restaurant may be closed, fully booked, or unsuitable for your family even if it appears on your itinerary.
Cost estimates in the Service are planning aids, not quotes or guarantees. Actual prices may differ.
familyTravely does not operate or control third-party attractions, restaurants, hotels, rental car companies, rideshare providers, ticket sellers, or transit agencies.
Your responsibility to verify travel information
You are solely responsible for confirming all information that matters for your trip before and during travel, including bookings, reservations, tickets, visas and entry requirements, health and vaccination guidance, local laws, transit and driving rules, accessibility, supervision of children, and whether a suggested activity or venue is appropriate for your family. Do not rely on the Service as your only source for safety-critical or legally required information.
Accuracy disclaimer
THE SERVICE AND ALL ITINERARIES, SUGGESTIONS, MAPS, AND ESTIMATES ARE PROVIDED FOR PLANNING PURPOSES ONLY. WE DO NOT GUARANTEE THAT ANY ITINERARY IS COMPLETE, ACCURATE, UP TO DATE, OR SUITABLE FOR YOUR FAMILY. YOU ARE RESPONSIBLE FOR CONFIRMING IMPORTANT DETAILS BEFORE YOU TRAVEL, INCLUDING BOOKINGS, TIMES, PRICES, VISAS, HEALTH REQUIREMENTS, AND LOCAL LAWS.
Third-party travel providers and bookings
Any transportation, lodging, tickets, insurance, or other travel products or services you obtain through third parties are provided by those third parties, not by us. We do not arrange, broker, or guarantee third-party services. Third parties set their own prices, terms, cancellation and refund policies, and eligibility rules.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE ARE NOT RESPONSIBLE FOR ACTS, OMISSIONS, ERRORS, REPRESENTATIONS, WARRANTIES, BREACHES, OR NEGLIGENCE OF ANY THIRD-PARTY PROVIDER, OR FOR ANY PERSONAL INJURY, DEATH, PROPERTY DAMAGE, LOST PROFITS, LOST DATA, DELAYS, CANCELLATIONS, CLOSURES, MISSED CONNECTIONS, OVERBOOKINGS, STRIKES, WEATHER, PANDEMICS, GOVERNMENT ACTIONS, OR OTHER EVENTS OUTSIDE OUR REASONABLE CONTROL THAT AFFECT YOUR TRIP OR ANY BOOKING YOU MAKE.
Travel safety
Travel involves inherent risks. We do not provide safety, security, medical, or emergency advice. You are solely responsible for assessing whether destinations, activities, transportation options, and venues are appropriate for your family, including supervision of children.
Children and family responsibility
Parents, guardians, and accompanying adults are responsible for children at all times. A suggested activity or venue on an itinerary does not mean it is age-appropriate, safe, or legally permitted for your children in your circumstances. Use your own judgment.
Dietary and allergy disclaimer
Dietary labels, restaurant suggestions, and food-related notes in the Service are informational only. They are not a guarantee of ingredient accuracy, allergen-free food, kosher or halal certification, or safe food preparation. Cross-contact and menu changes are common. If dietary safety is important (including severe allergies), verify directly with the venue and carry appropriate precautions. Do not rely on the Service as your sole source for medical or allergy decisions.
Availability of the Service
We strive to keep the Service available, but we do not guarantee uninterrupted or error-free operation. Features may be limited, changed, or unavailable in some regions or configurations. API rate limits may apply.
Changes to the Service
We may modify, suspend, or discontinue any part of the Service at any time. Durable itinerary links created through explicit email sharing may stop working after the limited retention period described in our Privacy Policy. Session-bound access after normal generation depends on your browser session and is not a permanent hosted link.
Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
Nothing in these Terms excludes or limits warranties or other rights that cannot be excluded or limited under applicable law.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE AND OUR LICENSORS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, ANY ITINERARY OR SUGGESTION GENERATED BY THE SERVICE, ANY TRIP YOU PLAN OR TAKE USING THE SERVICE, OR ANY THIRD-PARTY PRODUCT OR SERVICE YOU ACCESS THROUGH THE SERVICE—INCLUDING DAMAGES ARISING FROM ITINERARY ERRORS OR OMISSIONS, RELIANCE ON ESTIMATES OR SCHEDULES, TRAVEL DELAYS OR DISRUPTIONS, VENUE OR TRANSIT CLOSURES, CANCELLATIONS OR CHANGES BY THIRD PARTIES, PERSONAL INJURY, PROPERTY DAMAGE, THEFT, OR OTHER LOSSES OR EXPENSES—EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM (IF ANY).
Some jurisdictions do not allow certain limitations or exclusions of liability. In those cases, our liability is limited to the fullest extent permitted by applicable law, and nothing in these Terms affects rights that cannot be waived or limited under mandatory consumer protection or other non-waivable laws.
Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless us and our licensors and service providers from and against any claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use or misuse of the Service, your trip or travel decisions, your reliance on any itinerary or suggestion, your dealings with third-party providers, your violation of these Terms, or your violation of any law or third-party rights.
This indemnification does not apply to the extent a claim arises from our gross negligence or willful misconduct where such limitation is not permitted by applicable law.
Termination
You may stop using the Service at any time. We may terminate or restrict your access if you violate these Terms or if we reasonably believe your use poses risk to the Service or others.
Changes to Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Continued use after changes become effective constitutes acceptance of the revised Terms, to the extent permitted by law.
Governing law and disputes
These Terms are governed by the laws of the State of Israel, without regard to conflict of law principles, except where mandatory consumer protection laws in your country of residence require otherwise.
